MON VALLEY PALLETS: DUMP TRAILER RENTAL & WASTE DISPOSAL TERMS

1. RENTAL SERVICE FRAMEWORK

By submitting an intake booking request, checking the agreement box, or executing an invoice payment, the Customer agrees to be bound by the standard operational, legal, and environmental parameters outlined herein.

2. FEES, PAYMENTS, & SALES TAXES

  • Base Rental Rate: Determined by the specific service plan selected during checkout.

  • Transport Fee: Calculated dynamically at a rate of $3.44 per one-way mile from our yard in Rices Landing, PA to the service address. This fee covers all four operational transport legs (Delivery, Drop, Pickup, and Landfill return).

  • Taxes: All base rental rates, delivery fees, and transport surcharges are subject to applicable state and local sales taxes based on the delivery location jurisdiction. Taxes are automatically computed and billed via Square checkout.

3. CANCELLATION & BALANCE REFUND POLICY

  • 48+ Hours Notice: Full refund of all initial deposits and fees.

  • 2 to 48 Hours Notice: Forfeiture of an amount equal to a one-day rental rate; remaining balance refunded.

  • Less than 2 Hours Notice: Forfeiture of one-day rental rate plus the full calculated Transport Fee.

  • Post-Arrival: No refunds shall be issued once the delivery truck and trailer have arrived at the Service Address.

4. SITE PREPARATION, PROPERTY ACCESS, & DRY RUN FEES

  • Surface Conditions: Customer represents that the delivery destination is a flat, stable surface capable of supporting heavy commercial equipment and its fully loaded weight. Any deviation from a paved driveway onto lawns or soft surfaces requires Customer consent; Mon Valley Pallets is not liable for damage to underground utilities, pavement, or landscaping.

  • Maintenance & Condition Documentation: Mon Valley Pallets will capture digital photographic documentation of the trailer's condition immediately upon drop-off and again at pickup. Customer grants Mon Valley Pallets explicit right of entry to the premises to capture this documentation. These photos serve as the official record for maintenance tracking and damage assessment.

  • Insurance Disclaimer: Mon Valley Pallets provides NO INSURANCE POLICY or coverage for the trailer, its contents, or its operation under this agreement. Customer acknowledges that procurement of any desired insurance coverage is their sole responsibility.

  • Inaccessible Equipment (Dry Runs): Customer must ensure unobstructed access to the trailer on scheduled delivery, swap, and pickup days. If the trailer is inaccessible due to locked gates, blocking vehicles, structural obstructions, or unsafe surface conditions, a $150 Dry Run Fee will be charged to the card on file. Multiple landfill dumps are permitted under this agreement, provided that each additional transit/empty run requested by the customer triggers an independent dry run fee plus applicable landfill weight surcharges. Customer will be responsible for additional daily rental rates until access is cleared.

5. LOAD INTEGRITY & EXHAUSTIVE PROHIBITED MATERIALS

Debris must be distributed evenly. Loading higher than the side walls or exceeding the Gross Vehicle Weight Rating (GVWR) is strictly prohibited. Customer is liable for all fines, landfill overages, or overweight fees incurred.

The following items are strictly prohibited from being placed in the trailer unless given explicit written consent from a Mon Valley Pallets representative (a copy of which must be presented to the driver). Disposal of any of these items will result in immediate fines (minimum $25 per item) and potential total forfeiture of the trailer contents at the customer's expense:

  1. Aerosol cans | 2. Animals / Carcasses | 3. Antifreeze | 4. Appliances containing Freon (Refrigerators, AC units) | 5. Asbestos | 6. Auto parts | 7. Barrels | 8. Batteries (Lead-acid, lithium-ion, automotive) | 9. Biohazard / Medical waste | 10. Chemical products | 11. Computers / Monitors / Televisions | 12. Contaminated oils / Solvents | 13. Gasoline / Diesel fuel | 14. Dirt / Clean fill (unless pre-authorized) | 15. Drums | 16. Electronics / E-waste | 17. Fluorescent tubes | 18. Hazardous waste | 19. Herbicides and pesticides | 20. All free liquids / Lubricants / Hydraulic oil | 21. Microwaves | 22. Motor oil / Oil filters | 23. Flammable liquids | 24. Paint (except completely dry latex paint cans) | 25. Petroleum contaminated soil / Lead paint chips | 26. Tires | 27. Pressurized tanks (Propane, oxygen, fire extinguishers) | 28. Explosives (Ammunition, fireworks, flares).

Landfill Surcharges: If prohibited materials are discovered at the transfer station, the Customer will be charged the full amount of any environmental fines imposed on Mon Valley Pallets, plus a processing surcharge.

6. EQUIPMENT SECURITY, PROHIBITIONS, & RIGHT OF RETRIEVAL

  • No Towing: Customer is strictly prohibited from hooking to, moving, or towing the dump trailer themselves. The customer is entirely responsible for any and all damages to the trailer while it is parked on their premises.

  • GPS Monitoring: Equipment is GPS-tracked. Any attempt to tamper with or disable the GPS will result in immediate asset repossession and total forfeiture of the rental term.

  • Pump Compartment: Customer shall not access the front toolbox pump compartment or operate the hydraulic dump mechanism.

  • Right of Retrieval: In the event of a payment default, breach of terms, expiration of the rental term, or structural risk to the asset, Mon Valley Pallets retains an absolute and unconditional Right of Retrieval. Customer hereby grants Mon Valley Pallets an irrevocable license to enter the premises without notice to retake possession of the trailer. Mon Valley Pallets shall not be liable for trespass or minor property disruption caused by retrieval.

7. DISPUTE RESOLUTION, GOVERNING LAW, & LIABILITY

  • Governing Law: This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania. Any legal action, suit, or proceeding must be brought exclusively in the courts of Washington County, Pennsylvania.

  • Indemnification: Customer assumes all operational risk for materials loaded, site conditions, and trailer possession. Customer agrees to indemnify, defend, and hold harmless Mon Valley Pallets against any and all claims, lawsuits, damages, environmental fines, or liabilities (including attorney fees) arising from personal injury, death, or property damage relating to the placement or presence of the equipment during the rental term.

  • Severability: If any provision of this Agreement is deemed invalid or unenforceable by a court of law, the validity and enforceability of the remaining provisions shall not be impaired in any way.
